ADEQ Water Quality Division Fees — Update

ADEQ filed a Notice of Proposed Rulemaking with the Secretary of State’s office on April 7.  It is due to be published in the April 28, 2023, issue of the Arizona Administrative Register, and will be available on the Secretary of State’s website. In this proposed rule, ADEQ is pursuing fee increases that account solely for inflation to help address budget needs. State leaders have proposed an amendment to Senate Bill 1391 to support the ongoing work of the Division. If enacted, the bill will authorize a predictable annual source of funding for the Water Quality Fee Fund. If Senate Bill 1391 does not pass, ADEQ will revise its draft rule and reintroduce a version that would provide the Water Quality Division the needed supplemental source of revenue through higher fee increases.
